1. Introduction
Welcome to Stephens Image LLC! By engaging our services, you agree to be bound by these Terms of Service. These terms outline the rules and regulations for the use of Stephens Image LLC’s services.
2. Services
Stephens Image LLC provides professional real estate photography services. Our services include, but are not limited to:
• Residential and commercial property photography
• Aerial photography (if applicable)
• Virtual tours
• Photo editing and retouching
3. Booking and Payment
• Booking: Clients are required to schedule appointments in advance. Bookings can be made through our website, email, or phone.
• Payment: Payment is due upon delivery of the final product. Payments may be made by cash, check, or online via our website. Late payments may incur a 10% late fee. All sales are final, and no refunds will be provided.
• Cancellation Policy: Cancellations made within 6 hours of the scheduled appointment will be subject to a 50% cancellation fee. No refunds are provided for cancellations made less than 6 hours before the scheduled shoot.
4. Client Responsibilities
• Property Preparation: Clients must ensure that the property is clean and ready for the photoshoot. Any delays caused by unprepared properties may result in additional charges.
• Access: Clients must provide access to the property at the scheduled time. If the photographer is unable to access the property, a rescheduling fee may apply.
5. Delivery of Photos
• Turnaround Time: Photos will be delivered within 24 hours after the shoot unless otherwise specified. Rush delivery is available for an additional fee.
• File Format: Photos will be delivered in high-resolution digital format via a secure online gallery or file-sharing service.
• Revisions: Clients may request one round of minor revisions at no additional cost. Additional revisions will be subject to an extra fee.
6. Usage Rights
• Licensing: Upon full payment, clients are granted a non-exclusive, non-transferable license to use the photos for the marketing and sale of the property. Photos may not be used for other purposes without prior written consent from Stephens Image LLC.
• Photographer’s Rights: Stephens Image LLC retains the copyright to all photos taken during the shoot. We reserve the right to use photos for our portfolio, marketing, and promotional purposes unless otherwise agreed upon in writing.
7. Liability
• Damage to Property: Stephens Image LLC will exercise all reasonable care in handling and photographing the property. However, we are not responsible for any damages caused to the property during the shoot unless due to gross negligence.
• Limitations of Liability: In no event shall Stephens Image LLC be liable for any indirect, incidental, or consequential damages arising out of or in connection with our services.
8. Rescheduling
• Weather: In the event of inclement weather, the photoshoot may be rescheduled at no additional cost. We will work with the client to find the earliest available date.
• Emergency Rescheduling: Clients may reschedule the shoot once without penalty if done so more than 12 hours before the scheduled time.
9. Confidentiality
All client information and materials provided to Stephens Image LLC during the course of our services will be kept confidential and will not be shared with third parties without the client’s consent.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of [insert state/country]. Any disputes arising from these terms shall be resolved in the courts of [insert jurisdiction].
